Welcome to FoPHO.co.uk (Focusing on Photography), the free interactive photography resource. By using FoPHO and the services provided within, you are agreeing to the following terms of service. In these terms of service, "you" relates to the person using the FoPHO website and related services, "user" relates to anyone that visits the FoPHO website. "3rd party" relates to any person(s), businesses or other entities that advertise or promote their services on the FoPHO.co.uk website or offer their interactive services as part of, or in conjunction with, the FoPHO website, "FoPHO" relates to the website at www.fopho.co.uk, the website owner and any administrators of the fopho.co.uk website. "the website" refers to www.fopho.co.uk unless otherwise stated. These terms of service may be updated at any given time without notice so it is advisable to review the terms of service periodically to check for changes. Any significant changes may be advertised on the top of this page as well as in the body of the terms of service.

It is advisable for parents, who are letting their children have access to FoPHO, to advise them not to post any personal information relating to themselves or their locations in any of the interactive areas of the website.

It is also advisable to set any internet content filtering services to a recommended level. Whilst FoPHO are strict about the content allowed on the site and would always endeavour to keep the site clean, some images on FoPHO come directly from 3rd party sources via RSS feed and therefore FoPHO will not be held responsible for images posted in this manner. However, most images displayed on FoPHO from 3rd parties should be picked up by your personal content filtering settings and you should therefore set these accordingly.

Accordingly, as the legal guardian, it is your responsibility to determine whether any of the services and/or content on FoPHO are appropriate for your child.

FoPHO uses the 3rd party services of 'Google Friend Connect' for FoPHO member login and for various website gadgets. Please refer to the Google terms if you require any information directly related to these services.

'Google Friend Connect' services on the FoPHO website include interactive gadgets such as comments, ratings, reviews and questions-and-answers. Whilst FoPHO endeavour to moderate the comments and content left by FoPHO members and users of the FoPHO website to keep the information clean and accurate, under no circumstances will FoPHO be held liable for any slanderous, indecent or inaccurate information left within any of the websites interactive services and including, but not limited to errors and omissions in website content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Services.

If you provide any information that will be visible on the FoPHO website you are agreeing, in its entirety, to the following terms: (a) Any information that you submit to FoPHO will be your own content and not something taken from another source. (b) Any information that you submit to FoPHO will be not contain illicit language. (c) Any images you submit to FoPHO will not contain nudity, pornography, or cruelty to any living creature. (d) Any images you submit to FoPHO are your own work and do not contain copyright from another source. You are personally responsible for any content that you submit to FoPHO.

If you register as a member with FoPHO then you are agreeing that you will provide accurate information about yourself to the best of your knowledge.

If you contribute any content to FoPHO including, but not limited to, images, comments, reviews or other website content, FoPHO accepts no responsibility for the timescales in which your content is added to the site, deleted from the site, miss-delivery or failure to include or store this data.

If FoPHO have reason to believe that the information you have provided is inaccurate, indecent or incomplete, FoPHO has the right to remove this data, suspend/remove your account and refuse any future use of the services provided by FoPHO.

upload, post, email or otherwise transmit any content that is unlawful, harmful, abusive, harassing, tortuous, defamatory, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

harm minors in any way;

impersonate any person or entity, including, but not limited to, FoPHO personnel, or falsely state or otherwise misrepresent your affiliation with a person or entity;

forge FoPHO headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Services;

upload, post, email or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;

upload, post, email or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except with prior consent of FoPHO;

upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

intentionally or unintentionally violate any applicable law or regulation including, but not limited to, regulations promulgated by any securities exchange.

Images submitted to FoPHO may be selected for display in the 'Featured Photo' area of the website and/or the 'Daily Photos' page(s). A maximum of 5 images per day, per user may be submitted to FoPHO for consideration in these areas. FoPHO are not obliged to post any or all of the images you submit to the website and are not obliged to notify you of any outcome.

By submitting an image to FoPHO you are agreeing that (a) the image(s) you submit are your own work and do not contain any copyright (b) the image(s) you submit can be used on FoPHO without notice. (c) your name and a link back to your website or personal gallery can be posted alongside your image(s). (d) the image(s) you submit can be used in any future FoPHO marketing without notice. (e) the image(s) you submit are free of copyright and you consent to FoPHO submitting the image(s) to 3rd parties which could include stock photography agencies. (f) any monies received as royalties or fees, as a result of FoPHO submitting your image(s) to other 3rd party entities, will be the property of FoPHO and go towards the running and administration of the website.

FoPHO will not be held responsible for users downloading and/or using any images on the website. FoPHO may resize images for display on the website. FoPHO cannot be held responsible for images that become skewed or stretched due to individual user screen resolutions.

Any email address that is submitted to FoPHO upon submitting an image will automatically be registered to receive the FoPHO newsletter. This is not a regular mailing but will keep you informed of any new activities or changes happening on FoPHO. It is recommended to stay registered to receive these emails as they could contain important information about your submission, however you can unsubscribe - please see details in the FoPHO Privacy Policy (section 4).

Business and website details that are submitted to FoPHO for submission in the 'Photography Directory' are regulated as much as possible by FoPHO upon submission with frequent checks where possible thereafter. FoPHO will not be held responsible for any incorrect information listed in the directory however if you know of any incorrect information please contact us. FoPHO are not obliged in any way to list a business or website that has been submitted if it is deemed to include unsuitable content. FoPHO do have security measures in place on the website so that 'robots' cannot automatically submit random business or website details, however, if your business or website is listed in the 'Photography Directory' in error and/or was submitted by someone not in authority, please make us aware and we will remove/edit the listing - contact us.

Any email address that is submitted to FoPHO upon registering your business or website in the FoPHO Photography Directory will automatically be registered to receive the FoPHO newsletter. You agree to indemnify and hold FoPHO and its affiliate partners, agents, co-branders and other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of content you submit, post to or transmit through the services of FoPHO, your connection to the services and/or your violation of the FoPHO terms of service.

You agree not to reproduce, duplicate, copy, sell or exploit any portion of the services on FoPHO for any commercial purposes or financial gain without prior consent in writing.

Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the services of FoPHO, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the advertiser. To the fullest extent permitted by applicable law, you agree that FoPHO shall not be held responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such advertisers on FoPHO.

FoPHO accept no responsibility for URL links placed on the website by FoPHO users and/or affiliate or advertising partners. FoPHO will accept no responsibility for content of links nor of any products or services supplied via such links. If you find a link that has irrelevant or indecent content, please contact us.
